Welcome to The Curio Town. These Terms of Service apply to your use of thecuriotown.com and any purchases made through our store. By visiting our website or placing an order, you agree to these terms and our published Shipping, Return, and Privacy Policies.

Business Identity

The Curio Town is a privately owned business operated under the trade name “The Curio Town.” Throughout these Terms, “The Curio Town,” “we,” “us,” and “our” refer collectively to the business and its individual owner. The individual owner is expressly included as a protected party under every disclaimer, release, limitation of liability, and indemnification provision contained in these Terms.

Customer Responsibility and Assumption of Risk

Customers are responsible for using all products safely, lawfully, and only as intended. Customers agree to read and follow all labels, instructions, ingredients, and safety warnings.

To the fullest extent permitted by law, The Curio Town and its individual owner are not responsible for injury, loss, or damage resulting from product misuse, alteration, failure to follow safety warnings, unattended flames or incense, ingestion of nonedible products, access by children or pets, or an individual allergy or sensitivity when ingredients or materials were accurately disclosed.

Limitation of Liability

To the fullest extent permitted by law, The Curio Town and its individual owner shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website, a customer’s order, or the use or misuse of any product.

The total liability of The Curio Town and its individual owner for any customer claim shall not exceed the amount actually paid for the specific order giving rise to the claim.

These limitations apply regardless of the legal theory asserted. Nothing in these Terms excludes liability that cannot legally be limited or waived.

Indemnification

Customers agree to indemnify, defend, and hold harmless The Curio Town and its individual owner from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from the customer’s misuse, alteration, repackaging, resale, or unlawful use of a product; violation of these Terms; or violation of another person’s rights.

Products

We make every effort to describe and photograph our products accurately. Colors, packaging, handmade details, and vintage-style finishes may vary slightly. Products may be limited, one of a kind, or discontinued without notice.

Mystery Boxes and Curated Orders

Mystery boxes and curated orders are intended to contain a surprise selection of items based on the product description, theme, and number of items purchased. Product photographs show examples only and do not guarantee specific contents.

We may consider customer preferences when offered, but we cannot guarantee particular colors, designs, characters, or products unless specifically stated in the listing. Disliking a surprise item is not grounds for a return or refund.

Orders and Payment

All prices are listed in U.S. dollars. Applicable taxes and shipping charges will be shown at checkout.

We reserve the right to correct pricing or product-description errors, limit quantities, or cancel an order because of suspected fraud, inventory problems, or an obvious pricing mistake. If we cancel an order after payment, the amount charged will be refunded.

Customers are responsible for providing accurate billing, shipping, and contact information.

Shipping

The Curio Town currently ships within the United States only. Processing times and additional delivery information are provided in our Shipping Policy.

If we cannot ship an order within the promised time, we will contact the customer with available options, including cancellation and a refund when required.

Returns and Damaged Items

All completed sales are final. We do not accept returns or exchanges because our mystery boxes and curated items are selected and packed especially for each order.

If an order arrives damaged or incorrect, please contact us within 7 days of delivery with the order number and photographs so we can make it right. Nothing in these terms limits any rights that cannot legally be waived.

Packing Videos

When a customer requests or accepts a packing video, they give The Curio Town permission to record, edit, and share footage of their order being selected or packed.

We will not intentionally display a customer’s full name, address, payment information, or other private shipping details. The Curio Town retains ownership of the videos it creates.

Product Use and Safety

Customers are responsible for reading and following all product labels, instructions, and safety warnings.

Unless specifically labeled otherwise, decorative botanicals, crystals, fragrance items, miniature products, and apothecary-style goods are not intended for eating or drinking. Candles and incense should never be left burning unattended. Keep small objects, flames, fragrances, and other potentially hazardous products away from children and pets.

Customers are responsible for determining whether a fragrance, botanical, cosmetic, or other product is appropriate for their personal use.

Spiritual and Apothecary Products

Spiritual, symbolic, oracle, botanical, and apothecary-style items are offered for personal reflection, creativity, decoration, or entertainment. Individual experiences may vary, and The Curio Town does not guarantee any particular spiritual, emotional, financial, or health-related result.

Nothing sold or published by The Curio Town is intended to replace professional medical, legal, financial, or mental-health advice.

Intellectual Property

The entire world of The Curio Town—including its original concept, town and shop names, characters, backstories, stories, artwork, photographs, videos, logos, product names, descriptions, and designs—was conceived, created, and developed from the imagination of its founder and owner. All such content is the exclusive intellectual property of The Curio Town.

No license or permission is granted by visiting this website or purchasing a product. Content may not be copied, reproduced, adapted, republished, distributed, displayed, sold, imitated, or used for any commercial or noncommercial purpose without prior express written permission from the owner of The Curio Town. Giving credit or attribution does not constitute permission.

Prohibited Uses

You may not use our website or content to commit fraud, violate any law, interfere with website security, transmit harmful software, harass others, collect personal information without permission, or infringe upon intellectual-property rights.

Third-Party Services

Our website may use third-party services for payments, shipping, website hosting, or external links. Those services may have their own terms and privacy practices. The Curio Town is not responsible for the content or operation of unrelated third-party websites.

Our total liability relating to a purchase will not exceed the amount paid for the affected order, except where applicable law requires otherwise.

Governing Law
